PRIVACY

1. SMS/TEXT COMMUNICATION: Acme Partyworks will not share or sell SMS opt-in, or phone numbers for the purpose of SMS. Acme Partyworks will not use SMS/Text communication for any advertising purposes.  At anytime you decide to stop text communications, just text "STOP".

2. PERSONAL INFORMATIon: Acme Partyworks will not share or sell any personal information that it receives.

ADDITIONAL TERMS AND CONDITIONS

1. General Release/Indemnity/Hold Harmless: Purchaser agrees to waive any and all personal liability arising from the rental and operation of any rental items. Any injuries to anyone participating or not participating on the listed game(s) is the responsibility of the purchaser, NOT of Acme Partyworks. Purchase agrees to hold harmless and indemnify Acme Partyworks from any and all claims from personal injury and liability arising from the rental and operation of said rental items. There are inherent risks in the participation in or on any amusement ride device or attraction. Patrons accept the risks inherent in such activity. Patrons have a duty to exercise good judgment and act in a responsible manner while using the equipment and to obey all oral and written warnings. Persons with back, neck knee, bone, joint injuries, respiratory problems or who may be pregnant should not participate in any of these attractions. "

2. Safety: Customer will take all necessary precautions regarding the items rented, and protect all persons and property from injury or damage. Customer acknowledges that they are in charge of the operation and use of the Rental Equipment, and are fully responsible for its safe operation and installation if they picked up the unit as well as the return of the Rental Equipment in good working order.

3. Supervision: Purchaser agrees that all rental items will be fully supervised by attendants, who are at least 16 years of age). If the item(s) will not be supervised for any given time, then the rental item(s) must be shut down until the rental item(s) can be fully supervised. The attendant(s) must enforce all rules and remove any rider who does not follow the rules. Attendants and riders must not be under the influence of any mind-altering substances (drugs, alcohol, medications, etc) during operation. Acme Partyworks recommends the use of whistles for all operators / supervisors to control this ride.

4. Cancellation Policy: All monies received are non-refundable. Acme Partyworks must be notified, by the purchaser, at least 48 hours before your equipment is scheduled to deliver during normal business hours if you need to cancel (9am – 5pm Monday – Friday). If CANCELLATION PROTECTION has been purchased, the customer will receive the amount paid up to date of cancellation (less the protection plan fee) as a future store credit that can be used for up to 1 year from your original event date. If you opt out of the CANCELLATION PROTECTION (SHOWN IN THE ITEM LIST) and you are cancellation 48 hours or more from your delivery date, you will receive a future store credit for the amount paid up to the date of cancellation, less a 25% penalty fee, which is calculated from the total rental price. (SEE ATTACHED PROTECTION PLAN DOCUMENT). If you are cancelling inside of 48 hours (less than 48 hours) from your delivery date, no credits or event rescheduling will be honored."

ADDITIONAL TERMS AND CONDITIONS

5. Delivery: Lessor shall deliver the Rental Equipment to the street address specified by Customer as listed on the front side of this Agreement. Customer grants to Lessor the right to enter the property at the said street address (“Delivery Address”) for delivery, and required set up, if any, and for subsequent pick up of the Rental Equipment and any associated equipment or packing materials at the approximately specified times. Delivery is to ground floor only. Costumer is responsible for moving equipment up and down
any stairs.

6. Receipt/Inspection of Rental Equipment: Customer hires the Rental Equipment on an “as is” basis. Customer acknowledges that Customer will inspect the installation of the rental equipment and will personally inspect the rental items prior to its use, and will read the operating/safety instructions prior to use. Customer specifically agrees that such rental items will not be used if Customer finds that it is not suitable for Customer’s needs or any damage is found. Furthermore, the Customer agrees to contact the Lessor to report any damages prior to the end of their rental period.

7. Care of the Rental Equipment: Customer shall be responsible for any and all damage to any of the Rental Equipment not caused by ordinary wear and tear. “Ordinary wear and tear” shall mean only the normal deterioration of the rental equipment caused by ordinary, reasonable and proper use of the rental equipment. Customer shall be liable to Lessor for any and all damage, which is not “ordinary wear and tear” in an amount equal to the equipment value. Damage which is not “ordinary wear and tear” includes, but is not limited to, cutting or tearing of vinyl or netting, damage due to overturning, overloading, exceeding rated capacities, breakage, improper use, abuse, lack of cleaning, contamination of or dirtying of rental equipment with non-approved items such as sand, candy, duck tape, chemicals, food, paint, silly string (see Paragraph 10), mud, clay, or other materials. A minimum fee of seventy-five dollars will be applied to the charge card on the agreement if cleaning is required. Cleaning fees will be determined by actual time spent cleaning the equipment.

8. Equipment Problems: Should any equipment develop a problem, or does not function correctly at any time, or Customer does not understand the operating instructions, Customer agrees to immediately cease use of that equipment and contact the Lessor immediately. In particular, if the equipment includes an INFLATABLE, and the INFLATABLE unit begins to deflate, customer will immediately have the riders exit the INFLATABLE and then check for one of the following conditions: 1) The motor has stopped; in which case check the power cord connection at the outlet where the unit plugs into the house to make sure that it has not been unplugged; 2) If motor continues to run, check for blockage of the air intake screen on the side of the blower unit. Also, check both air tubes on the back of the INFLATABLE unit for snugness and tighten the ties if necessary; 3) If either of these steps corrects the problem, fully reinflate the INFLATABLE prior to permitting anyone to use the unit; 4) If you cannot correct the problem, call our emergency number at the top of this agreement.
